Madison County court records are accessible through several channels depending on the type of record needed and the level of detail required.

Any member of the public may request to inspect or copy court documents from government agencies in Madison County, and those agencies are legally required to comply, provided the requestor meets applicable requirements.

That said, the Act carves out a number of specific exemptions. In the context of court records, restricted categories include:

  • Judicial authorization of abortion for minors: Under Idaho Code § 74-110, records of court proceedings regarding judicial authorization of abortion procedures for minors are expressly exempt from public disclosure.
  • Records that may prejudice a fair trial: Arrest records or case documents whose release could interfere with an individual’s right to a fair trial or adjudication may be withheld.
  • Juvenile records: Records involving minors in delinquency or related proceedings are protected under Idaho law.
  • Medical and mental health records: Confidential under both state exemptions and applicable federal law.

Shielding of Criminal Records — Idaho Clean Slate Act

Idaho Court Administrative Rule 32

Public access to court records is also governed by Idaho Court Administrative Rule 32 (ICAR 32), which sets out the framework for public access, redaction, and the sealing of court records. Individuals who need to file both redacted and unredacted versions of documents can find redaction instructions on the Idaho Court Assistance Office website.
