The county seat of Caldwell houses both the District Court and its Magistrate Division in the Canyon County Courthouse at 1115 Albany Street. Court records generated here span criminal cases and civil disputes, family law matters, probate filings, protection orders, small claims, and infractions. The Canyon County Clerk’s office serves as the primary custodian of these records, processing thousands of filings each year. How to Look Up a Court Case in Canyon County?

There are three primary ways to search for a Canyon County court case: online, in person, or by mail.

Online searches

  1. Go to the iCourt Smart Search page.
  2. Enter the party’s last name (or business name), or type the case number directly.
  3. Apply optional filters such as case type or filing date to narrow results.
  4. Review the register of actions, hearing dates, and case status that appear in the results.

The Canyon County Recorder also maintains a Digital Research Room with an index of recorded documents from 1984 to the present. This portal is useful for land records, judgments, and liens. Document images, however, are not viewable online; they must be viewed on public terminals at the Recorder’s Office. Records from 1864 through 1997 are available on microfilm at the same location.

In-person visits

Walk-in visitors can access court records at the Clerk’s Office (Room 201) during regular hours. The office maintains public-access terminals for electronic records and microfilm/microfiche readers for older files. Photo identification is required when requesting records that are exempt from public disclosure under Idaho Court Administrative Rule 32.

Mail and online requests

The Clerk’s Office accepts written requests submitted through the Court Records Request form on the county website. Each request should include the case number, names of all parties, specific documents and their dates, and, for audio records, the hearing date. No audio recordings are available prior to 2006.

Accepted payment methods include Visa, Mastercard, Discover, money orders, business checks, and cash for in-office requests. Mailing fees are waived when a self-addressed stamped envelope is provided.

Are Court Records Public in Canyon County?

Most Canyon County court records are open for inspection and copying. Idaho Court Administrative Rule 32 establishes the framework for public access across the state’s unified court system. Under ICAR 32(d), the following categories of records are available to the public when they exist in a case file:

  • Litigant and party indexes
  • Listings of new case filings with party names
  • Chronological case summaries
  • Court calendars and dockets (case numbers, hearing dates, locations)
  • Minutes, orders, opinions, findings of fact, conclusions of law, and judgments
  • Transcripts and recordings of proceedings open to the public
  • Pleadings, motions, affidavits, briefs, and other documents filed in a case
  • Exhibits admitted or considered by the court (access to exhibits before final disposition requires the custodian judge’s permission)

ICAR 32(g) designates a lengthy list of records as confidential, and willful disclosure of these records may constitute contempt of court. Key categories of exempt records include:

  • Juvenile court records (Child Protective Act and Juvenile Corrections Act proceedings, with nuanced rules based on the juvenile’s age and offense severity)
  • Mental commitment case records
  • Adoption records
  • Records of proceedings to terminate parental rights
  • Protection order petitions (only court orders are public)
  • Pre-sentence investigation reports
  • Unserved arrest warrants and unreturned search warrants
  • Guardianship and conservatorship filings (though the register of actions, letters of guardianship or conservatorship, bond orders, and dispositive orders remain public)
  • Records in child custody, child support, and paternity cases (the register of actions and redacted orders remain public; other records may be released upon request and court review)

Personal identifiers — including Social Security numbers, financial account information, home addresses, and telephone numbers — are redacted from publicly accessible records. The Idaho Court Assistance Office publishes instructions on filing redacted and unredacted documents for parties handling their own cases.

Additionally, Idaho’s Clean Slate Act (Idaho Code § 67-3004(11)), effective January 1, 2024, allows individuals convicted of certain nonviolent, non-assaultive offenses to petition the court to shield their records from public view.

Canyon County Criminal Court Records

Criminal cases in Canyon County are divided between the District Court and its Magistrate Division. The District Court presides over felony trials and appeals from the magistrate level, while the Magistrate Division handles misdemeanors, infractions, and preliminary felony hearings.

Arrest records and local law enforcement

The Canyon County Sheriff’s Office maintains arrest records and police reports. Public records requests can be submitted through the Sheriff’s Office Records Request form online, by email, by mail, or by fax. A written response is provided within three business days of receipt; complex requests may take up to ten business days for Idaho residents or thirty-five business days for non-residents, per Idaho Code § 74-103(2).

Statewide criminal background checks

The Idaho State Police Bureau of Criminal Identification (BCI) operates the state’s central criminal history repository. Two types of background checks are available:

  • Name-based check: $20.00. No fingerprints required. A printable request form is available on the ISP website.
  • Fingerprint-based check (statewide): $25.00 (effective January 1, 2026).

Credit and debit card payments incur an additional $1.00 plus 2.5% of the transaction total. Cash, checks, and credit/debit cards are accepted. Under Idaho Code § 67-3008, criminal history information obtained from BCI may not be further disseminated to non-criminal-justice entities without a signed release from the subject.

Canyon County Civil Court Records

Civil litigation in Canyon County is split by amount in controversy. The District Court handles civil cases where more than $10,000 is at stake, while the Magistrate Division covers disputes of $10,000 or less as well as small claims of $5,000 or less.

How to obtain civil records

Civil case records can be searched through the iCourt Smart Search tool or inspected in person at the Clerk’s Office. Copies and certified copies follow the standard fee schedule ($1.00 per page; $1.00 per certification). The Court Records Request form on the county website accepts mail and online submissions.

Small claims forms can be completed and e-filed through the Idaho Court Assistance Office website. In-person filing at the courthouse does not require an appointment, but all paperwork must be complete at the time of filing. An index of recorded documents from 1984 forward can be browsed through the Recorder’s search portal. Recording fees are set by Idaho Code § 31-3205 and include $15.00 for the first 30 pages of a deed, $45.00 for a mortgage (first 30 pages), and $3.00 for each additional page over 30. Certified copies from the Recorder cost $1.00 per page plus $1.00 for certification. The Canyon County Assessor operates a property search portal with parcel data, valuations, and ownership details.

Canyon County Family Court Records

Family law matters — including divorce, child custody, child support, paternity, domestic violence protection orders, and juvenile compromise claims — are adjudicated by the Canyon County District Court. There is no separate family court division; these cases are assigned to circuit judges and magistrates within the existing court structure.

Searching family case records

Because ICAR 32(g)(20) classifies records in child custody, child support, and paternity cases as confidential, public access is more limited than for standard civil or criminal cases. The register of actions and redacted copies of orders and judgments remain public, but other documents in the file are restricted. Any individual may file a court-provided form asking the judge to make additional records available; the judge will then review the file and release records that do not allege abuse, abandonment, or neglect of a child, or that would not inflict undue embarrassment or risk to a child referenced in the record.

Protection order petitions and related documents are also confidential under ICAR 32(g)(16), although the court’s orders themselves are public.

Divorce filing

The filing fee for a divorce case in district court is $175.00 (or $120.00 if assigned to the magistrate division). A motion to reopen or modify a divorce decree carries a separate fee of $108.00. Free divorce forms and guided questionnaires are available from the Idaho Court Assistance Office. The Third Judicial District Court Assistance Office also hosts weekly online workshops covering divorce with children, custody, and child-support paperwork.

Child support

Canyon County provides a child support information form on its website. Uniform Income Withholding Order forms and instructions are published by the Idaho Court Assistance Office.

Marriage licenses

Marriage licenses are issued by the Canyon County Recorder & Passport Office. Both applicants must appear together with government-issued photo ID and their Social Security numbers. No appointment is needed; the office is open Monday through Friday, 8:00 AM to 5:00 PM (arrive by 4:45 PM). The license fee is $28.00. An online marriage application can be completed in advance. Idaho imposes no waiting period — couples may marry immediately after obtaining the license. Certified copies of a Canyon County marriage license are restricted records under Idaho Code § 39-270. Only the couple, qualifying family members, legal representatives, law enforcement, or persons demonstrating a property-right interest may obtain copies. Birth and death certificates

Certified copies of Idaho birth and death certificates are issued by the Idaho Bureau of Vital Records and Health Statistics. Each certificate costs $16.00 and can be ordered online or by mail. Birth records are confidential for 100 years and death records for 50 years; only eligible requesters (the record subject, immediate family, or those with qualifying documentation) may obtain certified copies.

Canyon County Probate Court Records

Probate matters in Canyon County are heard by the Magistrate Division of the District Court. Case types include wills and estate administration, guardianships of minors and incapacitated persons, conservatorships, trust registration, and mental commitments.

How to access probate records

Probate case summaries and hearing dates can be searched on the iCourt portal using the party’s name or the case number. Copies of probate documents can be obtained from the Clerk’s Office by visiting in person or submitting the online Court Records Request form. No filing fee is charged for registration of trusts, renunciations, petitions for leave to compromise a minor’s claim, or demands for bond before appointment of a personal representative.

Confidentiality of guardianship and conservatorship files

Under ICAR 32(g)(19), all filings in guardianship or conservatorship proceedings — whether for an adult, minor, or developmentally disabled person — are confidential. However, four categories of documents remain open to the public: the register of actions, letters of guardianship or conservatorship (including supplemental orders), any bond-related orders, and any order dismissing or disposing of the case. Interested persons as defined in Idaho Code § 15-1-201, guardians ad litem, court visitors, and monitoring entities may access the full file.
