The office has 72 hours to review and respond to requests. Documents that qualify as public records will be emailed to the requester. Electronic certification is available. Are Court Records Public in Blaine County?
Court records in Blaine County are presumptively open to the public under the Idaho Public Records Act (Idaho Code § 74-101 et seq.) and Idaho Court Administrative Rule 32 (ICAR 32), which together establish the public's right to inspect and obtain copies of most court documents. Under Idaho Code § 74-102, all records are presumed open unless an exemption specifically applies.
That said, a defined set of records is shielded from public disclosure under Idaho Code § 74-104 and ICAR 32(g). The following categories are restricted or confidential:
- Juvenile records — protected to preserve the privacy of minors involved in court proceedings
- Mental health commitment records — sealed from public access under state law
- Adoption and parental termination records — confidential by statute
- Child custody, child support, and paternity records — restricted under ICAR 32(g)
- Sealed or expunged records — including those shielded under Idaho's Clean Slate Act, which allows eligible individuals to petition to shield criminal records from public access after completing their sentence, probation, parole, fines, and restitution
- Attorney-client privileged communications and work product
- Law enforcement investigatory records where release could compromise a fair trial or reveal the identity of a confidential source
- Any records otherwise restricted by state or federal law
Idaho's Clean Slate Act provides a formal process for shielding eligible criminal records after a five-year waiting period following sentence completion. Shielding does not destroy records but removes them from public access. Petition forms and instructions are available from the Idaho Supreme Court.
Blaine County Criminal Court Records
Criminal cases in Blaine County are divided between the District Court and the Magistrate Court based on the severity of the offense. The District Court handles felony matters — serious offenses carrying potential sentences exceeding one year. The Magistrate Court has jurisdiction over misdemeanors, traffic infractions, and other lower-level criminal matters. Both courts operate from the Kramer Judicial Building at 201 South 2nd Avenue in Hailey.

Accident and incident reports in which a requester is a named party may be requested separately through the Accident/Incident Records Request form. The fee for insurance company requests is $5.00 per report, with an additional $5.00 per disc for photographs, audio, or video. Parties directly involved receive copies free of charge.

Blaine County Civil Court Records
Civil disputes in Blaine County are handled at two levels depending on the amount in controversy. Family court records are maintained by the Clerk of the District Court and generally require the case number and party names to retrieve specific documents. Because many family court filings involve minor children, access may be restricted under ICAR 32(g). Divorce decrees and related filings are held by the Clerk of the District Court. Marriage records in Idaho are confidential for 50 years from the date of the event.
